Since the passage of the 2018 Farm Bill, which federally legalized hemp cultivation, the hemp-derived cannabinoid market has widely expanded.

A massive oversupply of hemp led to an oversaturated CBD market starting in 2019, according to an article published in the May 2021 issue of former CBT sister publication Hemp Grower. Processors then began to convert hemp extracts into other more lucrative products using THC isomers and derivatives, including the most widely known delta-8 THC, but also delta-10 THC, HHC (chemically known as hexahydrocannabinol), THC-O acetate and more.

In June, the 9th Circuit Court of Appeals ruled that delta-8 is legal under the 2018 Farm Bill, leaving it up to states to adopt regulations surrounding the cannabinoid. Despite the ruling, delta-8 is still stuck in a legal gray area.
