Missouri DHSS Files Proposed Rule Amendments Regarding Cannabis Facilities

The proposals aim to clarify and improve ownership requirements, establish rules for license transfers, clarify recall procedures and address rule violations.

[PRESS RELEASE] – JEFFERSON CITY, Mo., Oct. 1, 2026 – The Missouri Department of Health and Senior Services' (DHSS) Division of Cannabis Regulation (DCR) has filed proposed rule amendments to 19 CSR 100-1.070 Facility Ownership and Employment and 19 CSR 100-1.100 Facilities Generally with the Secretary of State and the Joint Committee on Administrative Rules.

Before initiating the formal rulemaking process, DHSS proactively gathered public feedback to promote transparency among stakeholders and enhance the efficiency of the process. 

The proposed amendment to 19 CSR 100-1.070 clarifies ownership requirements for medical and comprehensive facilities, including the impact of rule violations on facility ownership and employment. 

The proposed amendment to 19 CSR 100-1.100 is designed to improve cannabis licensee operations by: 

  • removing a requirement for preapproval when a licensee changes its ownership by 50%;
  • establishing a framework for approval of publicly traded companies’ ownership in cannabis licenses;
  • establishing a framework for transferring microbusiness licenses to eligible family members;
  • clarifying recall procedures for cannabis products that cannot be properly traced back to cannabis grown in a licensed Missouri cannabis facility; and
  • addressing how individuals’ prior violations of rules may affect their participation in the regulated cannabis industry.  

The proposed amendments will be published in the Nov. 2, 2026, issue of the Missouri Register, which can be found on the Secretary of State’s website. Public comments will be accepted from Nov. 2 – Dec. 2, 2026.  

DHSS expects to file the final version of the rule amendment next year.
