Rhode Island Lawmakers Seek to Dismiss Governor’s Lawsuit Over Cannabis Law

Rhode Island lawmakers have asked a judge to dismiss Gov. Gina Raimondo’s lawsuit over the state’s medical cannabis law.

Raimondo filed the litigation against the state’s General Assembly last month to take exclusive control of medical cannabis and hemp legislation after lawmakers awarded themselves the power to veto cannabis-related regulations earlier this year in the state budget.

Lawmakers argued in a Nov. 8 legal motion that court intervention is not necessary because House Speaker Nicholas Mattiello and Senate President Dominick Ruggerio have indicated that they will repeal the provision in question when the legislature reconvenes in January, according to The Morning Call.

Raimondo, however, is arguing that the new law violates the state constitution by giving lawmakers “unchecked control” over executive rulemaking authority, the news outlet reported, and that legislative leaders should convene sooner to address the issue.
