[PRESS RELEASE] – HARRISBURG, Pa., Sept. 24, 2026 – As the Pennsylvania Senate Democratic Policy Committee prepares to convene at 1 p.m. on Sept. 25 to discuss adult-use cannabis, new reports underscore why legislative action cannot wait: Without a taxed and regulated marketplace, criminal enterprises are currently siphoning off millions in untaxed revenue.
The committee will hold a hearing titled "Adult-Use Cannabis: Criminal Justice, Safety & Economic Impacts" in Philadelphia, chaired by Sen. Nick Miller (14th District) and co-chaired by Sen. Sharif Street (3rd District). The hearing comes just one week after Pennsylvania Attorney General Dave Sunday announced charges against 12 people in an alleged $18.7 million scheme to sell high-potency marijuana products disguised as legal hemp across the state.
ResponsiblePA underscores that the timing could not be more urgent.
"Weed is already here in Pennsylvania – masquerading as legal hemp, but actually selling as full-on, high-potency THC," said Monica McCafferty of ResponsiblePA. "These illegal, untested products are lining the shelves of gas stations and smoke shops, landing in the hands of kids with zero oversight or labeling. A fully taxed and regulated framework gives law enforcement and prosecutors the bright line and real tools they need to dismantle these criminal networks. By stripping away the marketplace organized crime exploits, Pennsylvania can eliminate underground sales and clear the path for responsible, lab-tested operators."
Consumer demand for an adult-use cannabis market is real in the Keystone State, with voters supporting it by nearly 70%. Consumers would rather close the illicit intoxicating hemp market, also known as “gas station weed,” and replace it with a responsible, regulated model. Two bipartisan, bicameral pieces of legislation already exist to pass meaningful reform. Lawmakers owe it to their constituents to have a real debate.
The Loophole
The recent Pennsylvania investigation and arrests stem from routing intoxicating “hemp” through large distribution warehouses to convenience stores, vape shops, and gas stations statewide. This activity is only possible because of a gap in the 2018 Farm Bill. That loophole allows bad actors to convert hemp-derived CBD into intoxicating, marijuana-strength products and sell them under the "hemp" label to dodge state cannabis laws and taxation. These are not the health and wellness products the hemp industry claims to represent – several have been marketed as candy-like edibles.
A Stalled Legislature
Senate Bill 49, which would have created a state Cannabis Control Board, stalled over the summer. Sen. Street then attempted to force a parliamentary vote on his adult-use bill, S.B.120, but it was calendared. Additionally, this year's state budget passed without a legalization framework. That leaves Pennsylvania with no plan of its own – and the clock is running.
When the federal hemp loophole closes in December following congressional action, illicit THC products will lose their legal cover overnight – but federal action only works if Pennsylvania acts. We need state legislation that mirrors this federal move so local police and prosecutors have the tools and resources necessary to enforce the law. The most logical path forward is legalizing adult-use cannabis sales, allowing Pennsylvania to channel consumer demand into a licensed, safe and lab-tested retail system.
ResponsiblePA is encouraged that Friday's hearing is taking place and calls on the Legislature to use it as a starting point for real reform – not another year of delay. The group encourages lawmakers to recognize that Pennsylvania has the opportunity to establish a competitive, responsible marketplace that delivers meaningful economic benefits for communities across the Keystone State.
