Nevada County Considers Rules for Recreational Marijuana Establishments

An ordinance banning recreational retailers will come before the commissioners for a second reading before becoming law.


ELKO — Concerns over federal law and security regarding recreational marijuana establishments led the Elko County commissioners to vote 3-2 Wednesday on the first reading of an ordinance to prohibit such facilities in the county’s unincorporated areas.

“When we take our oath, we swear to support the Constitution and the government of the United States, right?” Commissioner Cliff Eklund asked Aug. 3, when the board directed county staff to draft the ordinance. “So if we are swearing to support not only the Constitution but the government of the United States, and the Government of the United States says it’s illegal, what kind of position does that put us in, having to support what they say is illegal?”

The ordinance would prohibit any establishment in the continuum of growing to selling marijuana, said Chief Civil Deputy District Attorney Kristin McQueary at the Aug. 16 meeting, but it would not affect individuals’ rights to grow their own. The rule would apply countywide except incorporated cities of Elko, Carlin, Wells and West Wendover.
