Alaska Releases Proposed On-Site Cannabis Consumption Rules

The state’s Marijuana Control Board seeks public input, with written comments due by Nov. 1.

Alaska’s Marijuana Control Board, which oversees the state’s regulatory system for cannabis, has released its proposed rules for the on-site consumption of cannabis at approved locations.

Under the proposed regulations, a cannabis retailer in a freestanding location could become licensed to sell adults 21 and older up to a gram of cannabis to be consumed on-site. Products containing up to 10mg of THC could also be made available for on-site consumption, although concentrates would be prohibited.

Security and access provisions for retailers offering on-site consumption would include measures to prevent diversion, measures to prohibit access to those under the age of 21 and ventilation that can remove visible smoke and that is signed and approved by a licensed mechanical engineer.

The proposed rules would solve Alaska’s ongoing problem of adult consumers having nowhere to consume cannabis except in private residences, which often leaves tourists unable to legally consume.

Written public comments on the proposed regulations are due no later than 4:30 p.m. on Nov. 1 and can be submitted by mail to 550 West 7th Avenue, Suite 1600, Anchorage, AK 99501 or electronically to [email protected]. The Marijuana Control Board will also hold a public hearing Dec. 19 in Anchorage to allow individuals to provide comments in person.
