Calaveras County May Have Easy Out for Cannabis Cancellation


Dennis Mills, an incoming member the Calaveras County Board of Supervisors, said the county may not be as liable for damages as many cannabis supporters have previously stated if a cultivation ban were to take place.

Mills said the municipality would be protected from any legal actions filed in the event of a change in policy. He said the urgency ordinance the board passed earlier this year includes a stipulation that participants of the commercial medical cannabis cultivation program agreed to a release of liability upon filing.

The document said neither the registrant nor property owner can pursue any type of action against any representative of the county in conjunction with site registration. The protection extended to any damages, costs of suits, attorney fees or any related costs incurred by the county or anyone associated.
