About the Data: Municipal opt outs are not allowed in New Mexico.
According to the Cannabis Regulation Act, a local jurisdiction:
- may “adopt time, place and manner rules that do not conflict with the Cannabis Regulation Act or the Dee Johnson Clean Indoor Air Act [Chapter 24, Article 16 NMSA 1978], including rules that reasonably limit density of licenses and operating times consistent with neighborhood uses;
- may not “prevent transportation of cannabis products on public roads by a licensee that transports cannabis products in compliance with the Cannabis Regulation Act” nor “completely prohibit the operation of a licensee.”

About New Mexico’s Adult-Use Cannabis Program: New Mexico became the 16th state to legalize adult-use cannabis when the state Legislature passed House Bill 2, which was signed into law by the governor on April 12, 2021. Adult-use sales began April 1, 2022.
