The first opt outs, if any, would not occur until the November 2024 election (by law), according Article XIV, Section 2 of the Constitution. As stated in the law: “Except as provided in this subsection, a local government may prohibit the operation of all microbusiness dispensary facilities or comprehensive marijuana dispensary facilities regulated under this section from being located within its jurisdiction either through referral of a ballot question to the voters by the governing body or through citizen petition, provided that citizen petitions are otherwise generally authorized by the laws of the local government.
