Pennsylvania Marijuana Growers Refile Research Permit Suit Against Health Department

Commercial medical marijuana companies claim the department is still shirking the research permit vetting process and creating a de facto “commercial super-permit.”

A collective of commercial medical marijuana companies in Pennsylvania claim the department is still shirking the research permit vetting process and creating a de facto “commercial super-permit.”

Changes to research permitting rules for Pennsylvania’s medical marijuana program apparently didn’t go far enough, prompting a collective of medical marijuana growers to refile a lawsuit from earlier this year.

An attorney for Medical Marijuana Advocates for Research, Judith Cassel, of Cannabis Law PA, said Monday that temporary regulations for marijuana suppliers take control away from the Department of Health and fall short of substantive research requirements.

"The (health department) is abdicating its constitutional obligation to vet and choose permit winners by allowing the (Academic Clinical Research Centers) to choose their partners,” Cassel said.
