“That provision is the reason why the FDA takes the position that CBD is illegal in food and dietary supplements. The States Reform Act would waive the [provision] for cannabis and for hemp, but it would still regulate hemp products under the FDA’s purview as food and dietary supplements, while cannabis products would be regulated largely by [the Alcohol and Tobacco Tax and Trade Bureau] … .”

Shawn Hauser, a partner at Vicente Sederberg LLP, said when explaining how the States Reform Act would change a provision in the Federal Food, Drug and Cosmetic Act that says a substance approved as a pharmaceutical ingredient—as CBD has been—cannot be used in food or dietary supplements. In late November, U.S. Rep. Nancy Mace, R-S.C., introduced the States Reform Act, which would end federal cannabis prohibition.

“There’s delta-8, there’s delta-10, there’s all kind of different cannabinoids associated with Cannabis sativa L. that are kind of out there and making the rounds. So, what I want to say—and I’ll be very deliberate and clear—at this time, I repeat again, at this time—per the [2018] Farm Bill, the only thing that is a controlled substance is delta-9 THC greater than 0.3% based on a dry-weight basis.”

Sean Mitchell, U.S. Drug Enforcement Administration (DEA) chief of intergovernmental affairs, said in a June virtual townhall meeting with Holly Bell, the Florida Department of Agriculture and Consumer Services’ cannabis director. That virtual townhall meeting was recently brought to light by cannabis and hemp attorney Rod Kight, who pointed out the DEA clarified that delta-8 and other hemp-derived cannabinoids are legal.
