Indiana Businesses Given Time to Remove CBD Oil

Indiana Excise Police will give businesses that sell CBD oil time to take it off the shelf after Attorney General Curtis Hill said the products are illegal.

Indiana Excise Police will give businesses that sell CBD oil time to take it off the shelf. Although some merchants may have been selling CBD oil products for years, Attorney Gen. Curtis Hill said last week that those products are illegal in Indiana and are subject to search and seizure. CBD is an extraction from the hemp plant and does not give the user a "high."

Indiana law now allows for some epileptic people to be able to use CBD oil to stop their seizures, under the care of a doctor, and as long as they register with the Indiana Dept. of Health. The state legislature is expected to further clarify the law this session on the purchase of CBD oil, or cannabidiol.

Governor Holcomb says applicable law and opinions were his guidance in asking Excise Police to perform normal, periodic regulatory spot checks of CBD oil products .His statement read in part, “Because CBD oil has been sold in Indiana for several years, the excise police will use the next 60 days to educate, inform and issue warnings to retailers so there is a reasonable period of time for them to remove products that contain THC."
